Terms of Use

By accessing, browsing, or using any website, platform, application, or service operated by Enersys Co., Ltd. ("Company," "we," "us," or "our"), including but not limited to enersys.co.th and all related subdomains (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must discontinue use of the Services immediately.

Enersys Co., Ltd. provides enterprise software solutions, consulting services, and digital tools designed for businesses operating in Thailand and the broader Southeast Asian region. Our offerings include, but are not limited to, the following:

• Genesis AI Platform — An agentic AI platform for Thai enterprises, providing intelligent knowledge base management, business intelligence, and workflow automation capabilities.
• PrivacyHub — A comprehensive PDPA compliance platform offering consent management, data subject request handling, breach management, and zero-PII architecture for organizations subject to the Personal Data Protection Act B.E. 2562 (2019).
• Odoo ERP — As an official Odoo Silver Partner in Thailand, we provide Odoo enterprise resource planning implementation, consulting, customization, and ongoing support services.
• Free Assessment Tools — Complimentary online evaluation tools including AEO/GEO readiness assessments, AI Readiness scoring, ERP Fit analysis, and PDPA Compliance scoring, provided for informational purposes only.
• Professional Services — Application development, data and AI consulting, DevOps engineering, and cloud migration services delivered under separate service agreements.
• Free Trial Programs — Complimentary 14-day trial access to select platforms, including Odoo ERP environments, subject to trial-specific terms and usage limitations.

The Company reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may also introduce new features, impose usage limits, or restrict access to certain portions of the Services at our sole discretion.

Certain Services may require you to create an account or register for access. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You must notify us immediately at contact@enersys.co.th if you become aware of any unauthorized use of your account or any other breach of security. The Company shall not be liable for any loss or damage arising from your failure to safeguard your account credentials. We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

All content, materials, software, algorithms, models, designs, trademarks, trade names, logos, and other intellectual property made available through the Services are the exclusive property of Enersys Co., Ltd. or its licensors and are protected by applicable intellectual property laws of Thailand and international treaties. No right, title, or interest in any intellectual property is transferred to you through your use of the Services. You may not copy, reproduce, modify, adapt, translate, distribute, reverse engineer, decompile, disassemble, or create derivative works from any part of the Services without our prior written consent. To the extent you submit, upload, or transmit any content through the Services ("User Content"), you retain ownership of such content but grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, process, and display such User Content solely for the purposes of providing and improving the Services.

You agree to use the Services only for lawful purposes and in accordance with these Terms. When using the Services, you shall not:

• Violate any applicable local, national, or international law or regulation, including but not limited to the Personal Data Protection Act B.E. 2562 and the Computer Crime Act B.E. 2550.
• Upload, transmit, or distribute any viruses, malware, ransomware, trojan horses, worms, or other malicious code or technology designed to disrupt, damage, or interfere with the operation of the Services.
• Attempt to gain unauthorized access to any portion of the Services, other user accounts, computer systems, or networks connected to the Services through hacking, password mining, or any other means.
• Interfere with or disrupt the integrity, performance, or availability of the Services or the servers and networks used to provide them.
• Use the Services, including any output, data, or insights generated therefrom, to develop, train, or improve any product or service that competes with the Company's offerings.
• Scrape, crawl, harvest, or extract data from the Services through automated means, except as expressly permitted by the Company in writing or through a published API.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.

The Company is committed to protecting your personal data in compliance with the Personal Data Protection Act B.E. 2562 (PDPA) and applicable data protection regulations. Our collection, use, storage, and disclosure of personal data are governed by our Privacy Policy, which forms an integral part of these Terms. Data submitted through our free assessment tools is processed solely for generating your assessment results and may be used in anonymized, aggregated form for research and service improvement. The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Services will be uninterrupted, error-free, secure, or free from harmful components. Results generated by our free assessment tools are indicative and informational only; they do not constitute professional, legal, or compliance advice. Outputs produced by AI-powered features, including those within the Genesis AI Platform, are generated by machine learning models and may contain inaccuracies. Users should independently verify all AI-generated outputs before making business decisions. Free trial programs are provided with limited functionality, and data created during the trial period may not be retained after the trial ends.

To the maximum extent permitted by applicable law, in no event shall Enersys Co., Ltd., its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Services. The Company's total aggregate liability shall not exceed the total fees actually paid by you to the Company during the twelve (12) months immediately preceding the event giving rise to the claim, or THB 10,000, whichever is greater. Neither party shall be liable for any failure or delay resulting from Force Majeure Events, including but not limited to natural disasters, war, epidemics, internet infrastructure failures, or government orders.

Either party may terminate the use of Services at any time. You may cease using the Services and close your account by contacting us at contact@enersys.co.th. The Company may suspend or terminate your access immediately, without prior notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately. Data retention and deletion will be handled in accordance with our Privacy Policy. Provisions that by their nature should survive termination shall remain in effect, including but not limited to Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts located in Bangkok, Thailand. Nothing in these Terms shall limit or exclude any rights you may have under the Thai Consumer Protection Act B.E. 2522 (1979), the Personal Data Protection Act B.E. 2562 (2019), or any other mandatory consumer protection legislation.

The Company reserves the right to update or modify these Terms at any time. When material changes are made, we will update the Effective Date at the top of this page and, where practicable, provide notice through the Services or via email. Your continued use of the Services after revisions become effective constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Services.
